1. Introduction & Definitions

These Terms and Conditions (“Terms”) govern all electrical services provided by SMR Electrical Services (“the Contractor”, “we”, “us”, or “our”), a sole trader registered in England & Wales, to any individual or organisation (“the Client”, “you”, or “your”) engaging our services.

“Services” refers to all electrical installation, maintenance, testing, inspection, and repair work carried out by the Contractor. “Works” means the specific tasks described in a quotation or agreement. “Site” means the location where the Works are to be performed.

By accepting a quotation or instructing us to proceed with any work, you agree to be bound by these Terms in full.

2. Scope of Work & Quotations

All quotations provided by SMR Electrical Services are valid for a period of 30 days from the date of issue unless otherwise stated in writing. Quotations are based on the information provided by the Client and a visual assessment of the Site at the time of survey.

Any additional work discovered during the course of the agreed Works that was not reasonably foreseeable at the time of quotation shall require a separate written agreement before being undertaken. We will notify you promptly of any such additional work and provide a supplementary quotation.

The Contractor reserves the right to withdraw or amend a quotation at any time prior to acceptance by the Client if there has been a material change in circumstances, including but not limited to changes in material costs or Site conditions.

3. Payment Terms

Unless otherwise agreed in writing, payment is due in full within 14 days of the date of invoice. For larger projects, we may require staged payments as outlined in the quotation.

We reserve the right to charge interest on overdue payments at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 and the Late Payment of Commercial Debts Regulations 2013. A fixed compensation charge may also apply as permitted under the Act.

Payment may be made by bank transfer, card, or such other methods as we may agree. The Contractor reserves the right to suspend or cease work if payments are not received in accordance with these Terms.

4. Warranties & Guarantees

All workmanship carried out by SMR Electrical Services is guaranteed for a period of 12 months from the date of completion. This guarantee covers defects arising from faulty workmanship and does not extend to fair wear and tear, misuse, or interference by third parties.

Materials and products supplied by us carry their respective manufacturer warranties, which are separate from and in addition to our workmanship guarantee. We will pass on all manufacturer warranty documentation to the Client upon completion.

Nothing in these Terms shall affect your statutory rights as a consumer under the Consumer Rights Act 2015.

5. NICEIC & Part P Compliance

All electrical work is carried out in accordance with BS 7671 (IET Wiring Regulations), the current edition, and all applicable Building Regulations, including Part P (Electrical Safety in Dwellings) where relevant.

As an NICEIC-registered contractor, we are authorised to self-certify notifiable electrical work. Upon completion of notifiable work, the appropriate Electrical Installation Certificate (EIC) or Minor Electrical Installation Works Certificate (MEIWC) will be issued, and notification will be made to the relevant Local Authority Building Control body.

Electrical Installation Condition Reports (EICRs) will be provided where requested or where required by regulation. All certification documentation remains the property of the Client.

6. Cancellation Policy

The Client may cancel or reschedule a confirmed appointment by providing at least 24 hours’ notice. Cancellations or changes made with less than 24 hours’ notice may incur a cancellation fee to cover lost time and costs incurred.

For works already commenced, cancellation by the Client shall require payment for all work completed to date, materials procured, and any reasonable costs incurred by the Contractor as a result of the cancellation.

Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, you have the right to cancel within 14 days of entering into the contract, provided that work has not commenced with your express agreement.

7. Liability & Insurance

SMR Electrical Services holds comprehensive public liability insurance and professional indemnity insurance. Copies of insurance certificates are available upon request.

Our total liability for any claim arising from or in connection with the Services shall be limited to the value of the contract or the limit of our insurance cover, whichever is lower, except in cases of death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

We shall not be liable for any indirect, consequential, or special losses, including but not limited to loss of profit, loss of business, or loss of data, except where such exclusion is prohibited by law.

8. Health & Safety

All work is carried out in compliance with the Health and Safety at Work etc. Act 1974, the Electricity at Work Regulations 1989, and all other applicable health and safety legislation.

Where the Construction (Design and Management) Regulations 2015 (CDM) apply, the Contractor will fulfil their duties as required and cooperate with the Principal Designer and Principal Contractor as applicable.

The Client shall ensure that the Contractor is provided with safe access to the Site and shall notify the Contractor of any known hazards, including the presence of asbestos or other hazardous materials, prior to the commencement of work.

9. Data Protection

SMR Electrical Services is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We collect and process personal data necessary for the provision of our Services, including your name, address, contact details, and property information. This data is used solely for the purposes of delivering the agreed Services, issuing certificates and invoices, and complying with our legal obligations.

Personal data is retained for a period of 6 years from the completion of work, in line with HMRC record-keeping requirements and the Limitation Act 1980. Electrical certification records may be retained for longer where required by regulation.

Your data will not be shared with third parties except where required by law, for the purposes of Building Control notification, or with your express consent. You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us.

10. Complaints & Dispute Resolution

We take all complaints seriously and aim to resolve any issues promptly and fairly. If you are dissatisfied with any aspect of our service, please contact us in writing in the first instance. We will acknowledge your complaint within 5 working days and aim to provide a full response within 14 working days.

If the matter cannot be resolved through our internal complaints procedure, you may refer the dispute to the NICEIC Complaints and Disputes Resolution Service, which provides an independent review process for work carried out by NICEIC-registered contractors.

Nothing in this clause shall prevent either party from seeking interim or injunctive relief from the courts where necessary.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to acts of God, severe weather, fire, flood, epidemic or pandemic, industrial action, government restrictions, power failure, or failure of third-party supply chains. The affected party shall notify the other party as soon as reasonably practicable and shall use reasonable endeavours to mitigate the effects of the force majeure event.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England & Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
